PUBLIC NOTICE: Elections 2022 – PETITION

Following the General Election held on 1 August 2022, the following litigation remains outstanding:

Civil Misc. 907/2022 – Napa v Iro, Matenga, Williams, and Chief Electoral officer: Application of recount of votes received for the constituency of Titikaveka.

Civil Misc. 937/2022 – Allsworth v Tangatapoto; Civil Misc. 938/2022, Boaza v Te-Hani Brown. Civil Misc. 940/2022 –Paratainga v Toki-Brown, Petitions for inquiry into the Election results for the Mitiaro constituency (Civil Misc. Number 937/2022), and the Atiu constituencies of Teenui-Mapumai (Civil Misc. 938/2022), and Tengatangi-Areora- Ngatiarua (Civil Misc. 940/2022).

Civil Misc. 942/2022 – Matenga v Williams and Chief Electoral Officer, Petition for inquiry into the Election results for the Titikaveka constituency.

Pursuant to ss 79(3) and 95 of the Electoral Act 2004, Public Notice is hereby given of the time and place at which the above litigation will be determined. Times and dates may alter without further Public Notice

The recount in Civil Misc. 907/2022 will be conducted at the Courthouse in Rarotonga on Wednesday, 28 September 2022, commencing at 9.00 am.

A joint hearing of Petitions Numbers Civil Misc. 937/2022, 938/2022, and 940/2022 will be heard at the Atiu Courthouse on 3 and 4 October 2022, continuing at the Sunday School Hall on Mitiaro on Wednesday, 5 October 2022, and concluding at the Courthouse on Rarotonga on Thursday, 6 October 2022, with all hearings commencing at 9.00 am.

Civil Misc. 942/2022 will be heard at the Rarotonga Courthouse commencing immediately on completion of the joint hearing of Civil Misc. 937/2022, 938/2022, and 940/2022 on Thursday, 6 October 2022 and Friday, 7 October 2022 but that hearing may not take place on that date and may be postponed.
